Welcome to Sociomator, a brand of Soflution. These Terms of Service ("Terms") govern your access to and use of the Sociomator mobile application and website (collectively, the "Service") operated by Soflution ("we", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not accept these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

Free Trial

We offer a 7-day free trial for new users. You will not be charged during the trial period. At the end of the trial, you must subscribe to a paid plan to continue using premium features.

Billing

  • Subscriptions are billed in advance on a monthly or annual basis.
  • All fees are non-refundable, except as expressly stated in these Terms or as required by law.
  • We may change our pricing at any time. Price changes will take effect at your next billing cycle.
  • You authorize us to charge your payment method for all fees incurred.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until then.

4. Your Content

Ownership

You retain all ownership rights to the content you upload, post or transmit through the Service ("Your Content"). By using the Service, you grant us a limited license to use, store and process Your Content solely to provide the Service to you.

Content Responsibility

You are solely responsible for Your Content. You represent and warrant that:

  • You own or have the necessary rights to use and authorize the use of Your Content
  • Your Content does not infringe any third-party rights, including intellectual property rights
  • Your Content complies with all applicable laws and regulations
  • Your Content does not contain any illegal, harmful or objectionable material

Prohibited Content

You may not upload, post or transmit content that:

  • Is illegal, fraudulent or deceptive
  • Infringes intellectual property rights
  • Contains malware, viruses or harmful code
  • Harasses, threatens or promotes violence
  • Contains hate speech or discriminatory content
  • Is sexually explicit or exploitative
  • Violates the terms of service of connected social media platforms

5. Social Media Integrations

The Service allows you to connect third-party social media accounts. By connecting these accounts, you:

  • Authorize us to access and post content on your behalf
  • Agree to comply with the terms of service of each connected platform
  • Acknowledge that platform limitations may affect Service functionality
  • Understand that we are not responsible for changes to third-party platform APIs or policies

6. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Disassemble, decompile or reverse-engineer the Service
  • Use automated means to access the Service without authorization
  • Resell or redistribute the Service without authorization
  • Use the Service to send spam or unsolicited messages

7. Intellectual Property

The Service, including its design, features and functionality, is owned by Soflution and is protected by intellectual property laws. You may not copy, modify, distribute or create derivative works based on the Service without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SOFLUTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Soflution and its officers, directors, employees and agents from any claim, damage, loss or expense (including reasonable attorney fees) arising from your use of the Service, Your Content or violation of these Terms.

11. Changes to the Service

We reserve the right to modify, suspend or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension or discontinuation of the Service.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms and revising the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without notice, for conduct that we determine violates these Terms, is harmful to other users or harmful to us.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of London, United Kingdom.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.
